Father, Perth children in custody row leave Malaysia. |
A PERTH woman fighting to be reunited with her children in Malaysia has
been devastated to learn that they have left the country.
The Department of Foreign Affairs and Trade confirmed that Jane Day's
children, Alison,3, and Justin, 4, left Malaysia on Wednesday with
their father, Alan Kwong Lun Chan.
Mr. Chan is Mrs. Day's former husband.
She alleges that her parents, Peter Chin and Christina Woo, kept her
children and their passports after they threw her out of their house
last May after a disagreement. She and the children were visiting them
on Labuan Island, off Sarawak in East Malaysia.
Her parents have rejected the claim, calling it mischievous.
A Department spokeswoman said Malaysian authorities had told the
Australian High Commission in Kuala Lumpur that the children had left
for Hong Kong.
"It's still a private legal matter but the Australian High Commission
in Hong Kong will provide consular assistance as and when required,"
the spokeswoman said.
Mr. Chan is a Hong Kong Chinese citizen who is understood to spend much of his time in mainland China.
Mrs. Day, 33, of Wilson, who is the children's legal guardian, said the battle to bring back Alison and Justin would continue.
"I don't know when this whole nightmare will be over," she said. "I will never give up finding my children."
Mrs. Day and her second husband, Geoffrey Day, 35, have spent the week
in Labuan trying to get back the two children who are Perth-born
Australian citizens.
She sought unsuccessfully for an interim custody order for the children
in Malaysia's High Court on Thursday, not knowing they had left the
country.
Mrs. Day said last night the couple were about to leave Labuan for Kuala Lumpur to start new legal proceedings.
The couple are awaiting a decision from Federal Attorney-General Daryl
Williams on their application for financial help to find and bring back
the children.
